Privacy notice

This notice covers this website and the enquiries it receives. It is written to be read, not to be survived, so if anything here is unclear please say so and we will fix the wording.

Who is responsible

The data controller is JTB Orthopaedics Ltd, registered in England and Wales, company number 16683156, registered office 83 Shaftesbury Avenue, Bristol, BS6 5LU. The company is the private practice of Mr James Berwin, consultant orthopaedic hip and knee surgeon (GMC 7138522).

What we collect, and why

Nothing, at the moment. There is no form on this website yet, so there is nothing here that takes your details. The ways to reach the practice are Lucie's telephone number and the practice email address, and what you tell her that way is handled as set out below.

An enquiry form is being added. When it is, it will ask for your name, telephone number and email address so Lucie can reply, one question about what would help you most, and an optional message box — and this page will list them before it goes live. It will not ask about your pain, your diagnosis or your medical history, and nothing on this site will ask for a date of birth, an NHS number, an address or an insurance policy number.

Where it goes

Your email or your call goes straight to the practice mailbox that Lucie works. It does not pass through this website at all. Nothing is stored on this website and nothing is written to a database.

Cloudflare hosts this website. When the enquiry form is added, Cloudflare will also run the code that turns it into an email and Brevo, a French company, will send that email — a postal service, not a recipient. Neither will keep a copy, and this page will say so before the form goes live.

The mailbox itself is Google Workspace, on Google's United Kingdom region. Your details are not sold, not shared with anyone else, not used for marketing, and not passed to your insurer or anyone else without your say-so.

The legal basis

Under Article 6 of the UK GDPR, we rely on steps taken at your request before entering into a contract — you have asked about an appointment — and, where that does not fit, our legitimate interest in answering people who contact the practice.

Where your enquiry contains health information, Article 9 also applies. We rely on Article 9(2)(h): the provision of health care by a professional bound by a duty of professional secrecy, with the corresponding condition in Schedule 1, Part 1 of the Data Protection Act 2018. Mr Berwin is GMC-registered and Lucie works under his responsibility. This is why there is no consent tickbox on the form: consent is not the basis being relied on, and a tickbox would misdescribe what is happening.

How long it is kept

We have not set a fixed deletion period yet. Enquiry emails are kept in the practice mailbox for as long as they may be needed in connection with your care and the practice's records. We would rather tell you that plainly than quote a retention period we are not yet applying.

This is being reviewed, and when a period is set it will be stated here. In the meantime you can ask us to delete your enquiry at any time and we will.

Your rights

You can ask us to:

• give you a copy of what we hold about you;
• correct anything that is wrong;
• delete it;
• restrict what we do with it, or object to it;
• send it to you, or to someone else, in a portable form.

Ask Lucie and she will deal with it. There is no charge, and we will respond within one month. Note that where information forms part of your clinical record, some of these rights are qualified — we will explain if that applies to you rather than simply refusing.

Please tell us first, so we can put it right. You also have the right to complain to the Information Commissioner's Office, the UK's data protection regulator, at ico.org.uk/make-a-complaint or on 0303 123 1113.
